ExpressJet Airlines, Inc. (“ExpressJet”) takes your privacy seriously. For that reason, and as described in greater detail below, we have published this privacy policy, taken appropriate measures to provide adequate security for your personally identifiable information, and have offered options for you to manage email correspondence related to your use of our web site. We promise to respect it. Therefore, we will not release your personally identifiable information to third parties except as described herein. We want you to know what happens when you provide us with information, and to feel comfortable that we will protect your information in the manner described below. YOUR CALIFORNIA PRIVACY RIGHTS

California residents who have an established business relationship with ExpressJet. If we collect your name or other personally identifiable information from you (whether online or offline), we will not share your information with third parties for their direct marketing purposes.

COLLECTION OF INFORMATION

When you purchase a ticket, make a flight reservation, join ExpressJet’s loyalty program or sign up for other ExpressJet promotional offers, you will be asked to provide certain personally identifiable information such as your name, home address, email address, billing address, telephone number(s), travel preferences, gender, age-related data, personal and/or professional interests, experience with our products or services, user ID, password, and answer to a security question.

When purchasing a ticket or making a flight reservation through ExpressJet, you will also be asked to provide your travel plans and payment information, such as a credit card number. You may also be asked to provide personally identifiable information to ExpressJet customer service representatives to research and resolve customer service problems or questions.

In addition to the information you provide, when visiting our web site our web server will automatically collect certain tracking information such as the domain name of the site providing you with Internet access, the Internet protocol address used to connect your computer to the Internet, the type of browser your computer uses, the type of operating system and platform your computer uses, and other aggregate data.

USE OF INFORMATION

ExpressJet will not sell or rent personal customer information including email addresses or customer lists to other companies. We use the customer information we collect in the following ways:

• For information you provide directly, such as for making flight reservations, ticketing information, joining the ExpressJet loyalty program, or email messages, we use the information to respond to your purchases of air transportation, participation in the ExpressJet loyalty program, and other requests.
• For some registration and use data, we may direct you to particular web pages, customize the web pages you see, send you special offers (see below) or otherwise increase the usefulness of the information you access through our web site.
• For information about ExpressJet web pages visited, page hits per week, and the like, we use this information internally to improve the functionality of our web pages.
• We may use third-party storage or service-provider companies to perform functions including performing data analysis, or processing data and assisting us in maintaining, upgrading, and managing our computer system or web site. During the time they are working with us, these parties may have access to information collected via our web site, but would be under a contractual duty of confidentiality to us and would not be authorized to make independent use of your personally identifiable information.
• In connection with your purchases from us by credit card, we share such information with the credit card provider as is necessary to facilitate billing and to respond to billing inquiries.
• You will need to provide your name, mailing address, and email address to subscribe to our U.S. mail and email notification services. These services include receiving your ExpressJet loyalty program account information, the ExpressJet newsletter and ExpressJet promotions. With your permission, we will send you information about services or offers that we feel may be of interest to you.
• In connection with your travel with us, we may share information we have collected from you with third parties on a limited basis to assist us in altering your travel arrangements, such as leaving messages at your phone number with respect to changes in flight schedules, or providing information to other airlines, hotels or others with respect to special accommodations due to irregular airline operations.
• When you make purchases of services or products of ExpressJet that are to be provided by another party (such as purchasing a travel segment on another carrier, hotel accommodations, or renting a car), your contact and billing information (including name, email address, credit card numbers, etc.) and other information may be provided to the other travel service provider(s) to facilitate the successful completion of your travel arrangements.
• We only share your personal information with entities that are designated as ExpressJet program partners if it is required to provide the product or service you requested. In working with our program partners, we require strict contractual obligations that ensure safeguards for the privacy of information we share.
• We may pass along offers from third party marketers in which we think you might be interested. Any special offers will be sent to you from ExpressJet. You may choose to restrict these marketing communications by following the procedure outlined below.
• We may provide information we collect about you to third-parties for the sole purpose of distributing promotions, sweepstakes, marketing surveys, focus groups, interviews and other opportunities offered by ExpressJet. These third-parties are subject to stringent data security and confidentiality requirements and, following completion of their services, all customer information is returned to ExpressJet or destroyed. You may choose to restrict these marketing communications.
• We may use the information we collect from you for administrative and analytical purposes such as information systems management, accounting, billing and audits, customer relations, and operation of ExpressJet’s loyalty program.

ExpressJet may, without notifying you, disclose personally identifiable information to protect our rights or property, to protect our web site or its users, or at the request of government regulators or other law enforcement officials and the courts (including the issuance of a valid subpoena). For example, as required by law or regulation, ExpressJet may collect and provide certain information regarding each passenger to the Transportation Security Administration of the Department of Homeland Security or other governmental agencies.

The information that could be supplied includes but is not limited to the passenger’s full name, home address, home telephone number, date of birth, or other required information. ExpressJet may provide personal information it collects to third parties or governmental agencies for the prevention, detection, apprehension or prosecution of criminal acts. We may also provide information with respect to immigration and customs authorities for flights to or from destinations outside of the United States.

CUSTOMER PROFILES

While a profile is not required to purchase a flight on our web site, having a profile may provide you with additional benefits as a member of ExpressJet’s loyalty program. With a profile, you may have the option of holding a reservation for up to 24 hours. You may also view your held or purchased itinerary at xjet.com. A profile stores your personal preferences, which may speed up the booking process. In addition, occasionally, you'll receive exclusive offers from ExpressJet sent to profile members. Again, these benefits are only available if you have a profile.

If you choose to build a profile, you will be asked to give your contact information, name, email address, user ID, password and security question. This information may then be used to speed and simplify the online reservation process. It is your option to provide information on preferences, but you are encouraged to do so. Your preferences assist ExpressJet in providing a more personalized experience on our web site. We may also retain your flight information and ask you to voluntarily provide us with information regarding your personal or professional interests, demographics, experience with our products, and contact preferences.

OPTING OUT

If you do not want ExpressJet to use or share your personal information for the purpose of sending you marketing or promotional materials, please submit your request to customercare@expressjet.com. Your request will be handled promptly but you may still receive marketing and promotional materials that were already in process prior to receipt of your request. If you are an ExpressJet loyalty program member, you should also contact ExpressJet customer care at 888.958.2001 regarding your request. Please note that you will continue to receive ExpressJet loyalty program newsletters, monthly statements, and surveys via post for as long as you are enrolled in the program.

SPECIAL DATA COLLECTION RULES FOR CHILDREN

ExpressJet does not knowingly collect personally identifiable information from children under the age of 13 except with prior parental consent. If you are under the age of 13, please do not provide personally identifiable information of any kind without parental approval. If a child under the age of 13 should do so without parental approval, the child’s parent or guardian may contact us at customercare@expressjet.com. Alternatively, you may call us at 888.958.2001. Promptly upon notification, we will delete any personally identifiable information collected without parental consent about a child under the age of 13.

COOKIES

Our web site can be more useful to you if it is able to recognize you when you are visiting it. So, our web site will place small identifying pieces of information on the hard drive of a computer when it visits our web site. These are called “cookies.” Cookies help us to remember something about you the next time you visit our web site. They allow us to better tailor our site to your needs by customizing your visit to our web site. Your browser should have an option that allows you to decide whether you will accept or decline the placement of cookies on your computer.

Thus, you have the ultimate say in whether cookies will be saved on your computer. In particular, we want you to know that no other company has access to ExpressJet’s encrypted cookie information except as described in this Privacy Policy. Moreover, your credit card information is not saved through a cookie.

USE OF YOUR EMAIL OR POSTAL ADDRESS

We will use your email or postal address to communicate with you, including providing your travel itineraries and confirmations. We may also use your email or postal address to inform you of products or services that we believe may be of interest to you. These offers may include great travel deals that we may offer from time to time. If you do not wish to receive promotional emails or postal mail from us, you can remove yourself from our distribution list by following the procedure outlined above or the “unsubscribe” instructions on these communications from ExpressJet or by otherwise “opting out” when you first give us this information over the phone or online. Even if, however, you choose not to receive these promotional communications from us, we may be required to send you a communication when we must comply with legal and regulatory obligations, and we also will continue to communicate with you with respect to matters related to your transactions with us or with respect to your ExpressJet loyalty program account (i.e. monthly account statements, surveys, and program newsletters).

SURVEYS

We may from time to time send you, via email or post on our web site an online survey to obtain information about our web site and services. Participation in these surveys is completely voluntary. Information gathered may be used in the aggregate to provide data-driven insight into our customers. The responses from individual participants will not be published on our web site or in printed research unless we give you prior written notice.

PROTECTION OF COLLECTED INFORMATION

ExpressJet takes all reasonable precautions to protect the personally identifiable information you provide us against unauthorized use or access. When you provide us with such information on our web site, it is automatically encrypted prior to transmission and then transferred over a Secure Sockets Layer (SSL) connection. SSL is the industry standard for secure data transfers and keeps the information you provide confidential during its transmission from your computer to ExpressJet.

After we receive your information, we store it behind a firewall that is intended to block access to it from anyone other than those ExpressJet employees, contractors, or vendors who are allowed to access this information. Moreover, we periodically review our security measures to make certain that they are protecting your personally identifiable information. We may keep all information in an off-line form, for archival purposes or as otherwise required by law.
